These Terms and Conditions (‘Terms’) are legal terms defined by Lulu Bloom Millinery (‘we’ ‘us’ ‘our’'). They set out the Terms and Conditions of Sale, Terms and Conditions for the use of the website (‘www.lulubloommillinery.com’) and the activities of website users (‘you’) and website visitors (‘you’) in relation to Lulu Bloom Millinery.

 

These Terms are an agreement between you and Lulu Bloom Millinery. They detail the policies and procedures conducted by the website.

 

These Terms and Conditions are in place to notify you of our activities and the relationship between you and us, and set forth the Terms and Conditions which you may use our website and services as offered by us.

 

This website is operated by Laura Jolly, a sole trader and owner of Lulu Bloom Millinery. The website is operated via a Wix.com platform. See ‘Lulu Bloom Millinery Privacy Policy’ and links to ‘Wix.com’s Privacy Policy’ for further information regarding the processing of your personal data.

 

The website offers you to browse and purchase (‘order’) headwear, build your bespoke headwear design via the virtual platform ‘Create with Lulu,’ or book an online consultation for a bespoke design with Laura Jolly, owner of the tradename Lulu Bloom Millinery. By accessing or using the website you agree that you have read and understood the binding nature of these Terms.

 

In order to use our website and/or receive make purchases/receive our services, you must be at least 18 years of age, or possess the authority of a legal parent or guardian to enter into these Terms as a binding agreement. You are not allowed to use this website and/or make purchases or receive services if doing do is prohibited in your country or under any law or regulation applicable to you.

 

Terms of Sale

 

General Terms of Sale:

 

When buying an item from Lulu Bloom Millinery, you agree that:

  • You are responsible for reading the full item listing before making a commitment to purchase the item.

  • You complete the checkout payment process in full.

  • If ordering a bespoke (‘commissioned’) item via independent communication with Lulu Bloom Millinery through the ‘Contact Lulu Bloom’ submission buttons on the website, or via the booking of, and ordering through an online consultation, you agree to be invoiced the agreed purchase amount of your bespoke order. The initial consultation fee for your online consultation, of £20, will be removed from the invoice total of your bespoke order, and this is payable on completion of your order. If you choose not to go ahead with a bespoke order after an online consultation, you are not entitled to a refund for the online consultation.

 

The prices charged for products and services are listed on our website. We reserve the right to change the Terms of Sale for any purchase or service provided by Lulu Bloom Millinery at any time, and to correct pricing errors that may have inadvertently occurred. As users and visitors of the website, you are agreeing to these Terms of Sale.

 

Certain products available on our website may be limited in their availability and we may need to notify you of a cancellation to your order if we are unable to fulfil it for you. We will endeavour to notify you within 48 hours of your purchase if this need arises and offer a full refund.

 

Orders may take up to 2 weeks to ship if products are not in stock and need to be crafted. You will be notified by e-mail if this is the case within 48 hours.

 

For bespoke commission orders, a time frame for completion will be agreed between you and us at the time of consultation.

Hire Service:

The headpiece(s) will always remain the property of Lulu Bloom Millinery.

Headpieces can be hired for more than one occasion; however, a hire fee is applicable to each specific wear date. Headpieces must be returned in between hire dates unless otherwise agreed with Lulu Bloom Millinery.

Headpieces will be sent to clients at least 2 days before their hire date via special delivery.

There will be no refund given for headpieces not worn when hired out unless otherwise agreed by Lulu Bloom Millinery.

Headpieces must be returned by the client in the same condition as received and in the original packaging provided - any concerns please get in touch. Items must be posted back to Lulu Bloom Millinery the next working day after the date a piece is hired for. Damaged or missing hat boxes will incur a charge at the discretion of Lulu Bloom Millinery.

In the event of damage or lost items the full sales price will be charged to the client unless otherwise agreed at the discretion of Lulu Bloom Millinery. 

Payment is due on reservation of the headpiece for a specific date. This will be confirmed via invoice.

Clients are responsible for delivery costs which will be invoiced at the same time as the hire fee invoice – this serves as the contract to confirm hire dates and client details, including address and contact information. If a client needs to make contact information alterations or delivery changes, this must be done so in writing for the avoidance of doubt and miscommunication as to where a hire piece will be sent.

 

Lulu Bloom Millinery will not take responsibility for issues arising with delivery that our deemed out of their control.

Clients are liable for any hired headpiece to them after it leaves the premises at Lulu Bloom Millinery, until it’s return (for the avoidance of doubt this includes the delivery services used).

In person collection is available via prior arrangement of a time and date.

Hired headpieces will be subject to a cancellation fee payable to Lulu Bloom Millinery if cancelled within 14 days of the event date – the full hire fee will be retained. If prior to the 14 days of the agreed hire date, a full refund will be given.

If headpieces are returned to Lulu Bloom Millinery damaged, clients will be responsible to pay the full cost price as advertised on the website. It is at the sole discretion of Lulu Bloom Millinery as to what constitutes normal wear and tear and irreversible damage or significant workmanship to repair an item. This will be discussed in full with the client.

Clients must check their headpiece on receipt of it thoroughly and contact Lulu Bloom Millinery immediately if they have any concerns regarding its condition.

Wherever possible Lulu Bloom Millinery asks all hire clients to keep any headwear hired from Lulu Bloom Millinery out of the rain. Headpieces are made with natural fibres and delicate materials which do not cope well with wet weather. Please use an umbrella and treat the piece with respect as if it was your own. This will help avoid any damage fees from stains, marks, indentations (not an exhaustive list). If there is damage to a headpiece, please contact Lulu Bloom Millinery and do not attempt repairs yourself.

Clients are responsible for the full purchase fee if a headpiece is lost or stolen - please inform Lulu Bloom Millinery immediately of any such occurrence.

If Lulu Bloom Millinery is unable to provide the headpiece agreed for hire, every effort will be made to find a suitable replacement. If this is not possible or the client does not agree to the replacement, a refund of the hire cost will be given in full.

Lulu Bloom Millinery reserves the right to change or modify the nature and terms of the Hire Service at any time and any updates will be reflected in these Terms and Conditions.

Gift Vouchers:

 

Gift vouchers are valid for 1 year from the date of sale, are non-refundable and cannot be exchanged for cash in full or in part. Gift vouchers must not be sold on and cannot be used to buy subsequent gift vouchers to extend the timeframe of validity. Unfortunately, we are unable to offer replacements for lost or stolen gift vouchers, and no credit or change will be given on an unused portion of any gift voucher. The terms and conditions of any gift vouchers available via Lulu Bloom Millinery are subject to amendment at any time at the discretion of Lulu Bloom Millinery and shall be binding to the customer and gift voucher recipient.

  • Gift Vouchers can be purchased in £50, £100, £150, and £200 denominations.

  • Customers can purchase multiple gift vouchers at the same time, however when gift voucher recipients and therefore customers are using gift vouchers and their specific voucher/coupon codes to make a purchase online via the website, customers are only able to use one gift voucher during a single transaction.

  • Gift vouchers can be used for online purchases via the website lulubloommillinery.com using the voucher code supplied on the gift voucher purchased.

  • Unfortunately, gift vouchers cannot be used for purchases within the ‘Children’s Collection’ unless the order exceeds £50, and are not applicable to be put towards ‘Postage and Packaging’ costs.

  • All gift vouchers purchased will be sent to the delivery address supplied at the time of purchase, and incur a postage and packing fee of £1.50 for first class post.

  • For customers wishing to use their gift voucher for a bespoke commission, customers are required to e-mail Laura at lulubloommillinery@gmail.com to arrange a consultation. The gift voucher amount will be deducted from the overall agreed commission price of the headpiece commissioned by the customer. If the agreed commission price does not exceed the gift voucher amount, unfortunately we cannot offer a refund or cash exchange for the difference. 

 

You agree to indemnify and hold Lulu Bloom Millinery harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the products and/or services offered on the website.

 

To the maximum extent permitted by applicable law, in no event shall Lulu Bloom Millinery, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Lulu Bloom Millinery assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

 

We reserve the right, in our sole judgment, to cancel any order placed. We reserve the right to cancel, limit or prohibit orders that appear to be placed by resellers, distributors or dealers for further financial gain. Please get in touch via e-mail for collaborations and stockist enquiries for separate contractual arrangements.

 

All direct payment are through secure gateways offered by Wix.com and used by Lulu Bloom Millinery who adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

 

 

Postage and packaging costs:

 

Postage and packaging costs are fixed per item (see further detail below). In making a purchase via the website you agree that the following postage and packaging costs will be added to your order. Purchasing more than one item will incur the same postage and packaging cost per item unless promotional codes are used. We reserve the right to adjust postage and packaging costs at any time without prior notice.

 

  • UK Postage & Packaging: £8.50 Special Delivery

  • Overseas Postage & Packaging: £12.50 Special Delivery

  • Children’s Collection purchases only: UK Postage & Packaging: £3.50 1st Class Recorded Delivery

  • Children’s Collection purchases only: Overseas Postage & Packaging: £6.50 for 1st Class Recorded Delivery

  • Gift Vouchers Postage & Packaging: £1.50 First Class Post

 

 

Returns and Refunds:

 

Returns are accepted for undamaged and unworn items within 14 days of purchase.  Returning an undamaged and unworn item must be done so in it’s original packaging and with the original receipt enclosed, and a full refund will be given based on the original payment method used by you.

 

Products applicable for returns and refunds are only able to be returned in the country in which they were originally purchased, the United Kingdom.

 

The following products are not eligible for returns or refunds:

  • Sale products

  • Bespoke commission order purchases: this includes orders placed through independent communication with Lulu Bloom Millinery; whether this is directly through the website and the ‘Contact Lulu Bloom’ submission buttons, or direct e-mail with lulubloommillinery@gmail.com

  • Bespoke commission orders made via an online consultation if you choose to go ahead with a bespoke order. If you choose not to go ahead with a bespoke order after an online consultation, you are not entitled to a refund for the online consultation but have no obligation to continue with your bespoke order purchase. This must be notified in writing to Lulu Bloom Millinery within 48 hours of the online consultation via lulubloommillinery@gmail.com

  • Purchases made via ‘Create with Lulu’

 

 

Retention of right to change offering:

Lulu Bloom Millinery, without prior notice to you, may change our products and/or services available; this includes stopping to provide products and/or services, or any features of the services offered. We may permanently or temporarily terminate or suspend access to purchases, bespoke orders or services without notice and liability for any reason, or for no reason. If a purchase has been made via the website and we are unable to fulfil the order, we will process a full refund within 14 days and notify you of your unfulfilled order within 48 hours of purchase.

 

Warranties and responsibilities for services and products:

Due to the nature of some materials used in creating Lulu Bloom Millinery headwear for purchase on our website, we cannot guarantee their robustness in inclement weather, especially rain, damp conditions and strong winds (the list of inclement weather conditions is not exhaustive), therefore we will not guarantee a refund for such conditions affecting the quality of the product purchased.

If we receive communication about a claim for a product purchased from us, if possible, we will endeavour to provide a repair for that product and reserve the right to seek payment for any repair work depending on the nature of the repair needed, and the time required to complete the repair work. Where a repair is not possible, we will notify you of this. You will not be entitled to an exchange or a refund if the product has been worn. If a product arrives to you in poor condition and not as seen on the website, please contact us. See the Returns and Refunds section for further information.

 

Ownership of intellectual property, copyrights, and logos:

Lulu Bloom Millinery products and services therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Lulu Bloom Millinery. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.


You recognise and agree that by sending Lulu Bloom Millinery your images of yourself and/or a purchased product, or written content, or by posting images or written content on social media platforms with the inclusion of any Lulu Bloom Millinery product, this action (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) confirms that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed on the website and used by Lulu Bloom Millinery for promotional purposes on both the website and social media platforms.

 

Right to suspend of cancel your online account:

Lulu Bloom Millinery reserves the right to either temporarily or permanently suspend your account with Lulu Bloom Millinery without notice and liability for any reason, including if it is our sole determination that you have violated any provision of these Terms and Conditions, as well any violation of any applicable law or regulation.

You may discontinue use, or request to cancel your account with Lulu Bloom Millinery at any time.

 

Right to change and modify Terms and Conditions:

Lulu Bloom Millinery reserves the right to modify these Terms and Conditions from time to time at our sole discretion. Therefore, it is your responsibility to review this page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made. Your continued use of the website and any purchase or service used after any such change, constitutes your acceptance of the new Terms.

If you do not agree to any of these Terms or any future version of the Terms, do not use or access (or continue to access) the website, do not or proceed to purchase any product or service through the website. Your continued use of the website and any transactions made constitute your agreement to these Terms.

Your submission of any personal information is governed by our Privacy Policy.

 

Promotional e-mails and content:

In providing Lulu Bloom Millinery with your contact information, including but not limited to your name and e-mail address, you agree to receive promotional messages and materials from us periodically.
